1. Agreement to these Terms
These Terms of Service (the “Terms”) are a binding agreement between you and Medicup (“Medicup”, “we”, “us”) governing your use of the Medicup platform: the medicup.ai website and web application, the Medicup mobile applications, Medicup AI, and every related service (together, the “Services”). By creating an account or using the Services, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of a healthcare organization, you confirm you are authorized to bind that organization, and “you” includes it.
2. Medical disclaimer — read this first
Medicup AI and the Services are not a substitute for professional medical advice, diagnosis, or treatment. AI-generated information is educational support: it can be incomplete or wrong, and it is never a medical opinion about you. Always seek the advice of a qualified healthcare professional with any questions about a medical condition, and never disregard or delay professional advice because of something you read in the Services.
Do not use the Services for emergencies. If you believe you are experiencing a medical emergency, call your local emergency number immediately. Safety features such as vitals monitoring, alerts, and SOS escalation are best-effort aids that depend on your device, sensors, and connectivity — they are not an emergency-response service and may fail, be delayed, or be inaccurate.
Where licensed clinicians provide care through the platform (tele-consultations, prescriptions), that care is provided by those professionals under their own licenses and professional responsibility; Medicup provides the technology that connects you.
3. Eligibility and your account
You must be at least 18 years old (or the age of majority where you live) to create an account. Accounts for minors may only be created and managed by a parent or legal guardian where the Services support it.
You must register with accurate information and a valid email address you control, and verify it when asked; unverified accounts may be restricted or suspended. You are responsible for safeguarding your credentials and devices, and for all activity under your account. Enable two-factor authentication where offered — we may require it for clinical and administrative roles. Tell us immediately at [email protected] if you suspect unauthorized access.
4. Healthcare professionals and organizations
Clinicians, pharmacists, and other professionals must hold and maintain the licenses and registrations their role requires, use the Services only within their scope of practice and applicable law, and complete our identity and credential verification (KYC) when requested. Organizations must complete business verification (KYB) and are responsible for the actions of the staff accounts they authorize.
Access to patient data is role-based, consent-gated, and audited. Accessing records without a legitimate care relationship or the patient’s consent is a material breach of these Terms and may be unlawful.
5. Acceptable use
You agree not to:
- use the Services unlawfully, or to harm, harass, or deceive anyone;
- access or attempt to access another person’s data without authorization;
- upload malware, probe, scan, overload, or otherwise attack the Services;
- reverse-engineer, scrape, or bulk-extract data from the Services;
- use the Services to build a competing dataset or train models without our written consent;
- misrepresent AI output as a professional medical opinion, yours or ours;
- circumvent safety, verification, rate-limiting, or access controls.
We may suspend or terminate accounts that violate this section, immediately where the violation risks patient safety or data security.
6. Your data and content
You own your health data and the content you submit. You grant Medicup only the license needed to operate the Services for you: to store, process, transmit, and display your content to you and to those you authorize, consistent with the Privacy Policy and your consents. You can export your data (JSON or FHIR R4) and request erasure at any time from your account.
You are responsible for the accuracy of the information you provide; clinical features depend on it.
7. Medicup AI
Medicup AI generates responses with artificial-intelligence models, grounded where possible in reputable medical sources and passed through safety checks. AI output may nonetheless be inaccurate, incomplete, or outdated, and does not create a clinician-patient relationship. Section 2 applies to all AI features, including meal, heart, symptom-image, and forecasting tools.
8. Intellectual property
The Services — including software, design, trademarks, and content we provide — are owned by Medicup or its licensors and protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the apps and Services as intended by these Terms. No other rights are granted.
9. Beta features and availability
Features labeled beta, preview, or in development (including the Android beta distribution) are provided as-is, may change or be withdrawn at any time, and may be less reliable than generally-available features. We work to keep the Services available and secure but do not promise uninterrupted or error-free operation; maintenance, updates, and factors beyond our control can cause downtime.
10. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICUP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES; AND OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THAT PERIOD OR USD 100. Nothing in these Terms excludes liability that cannot be excluded by law (including, where applicable, liability for death or personal injury caused by negligence, or consumer rights that apply in your country).
11. Indemnity
If you are a professional or organizational user, you will defend and indemnify Medicup against third-party claims arising from your provision of healthcare services, your breach of these Terms, or your violation of law, except to the extent caused by our own breach or negligence.
12. Suspension and termination
You may stop using the Services and delete your account at any time (data erasure works as described in the Privacy Policy). We may suspend or terminate access for material breach, legal requirement, or risk to security or patient safety — with notice where practicable. Sections that by nature survive (2, 6–8, 10–11, 13–14) survive termination.
13. Changes to the Services or Terms
We may update the Services and these Terms. For material changes we will give notice (for example, in-app or by email) before they take effect; continued use after the effective date means you accept the updated Terms. The “Last updated” date above always reflects the current version.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Medicup’s operating entity is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction — except where the consumer-protection law of your country of residence grants you mandatory rights or venue, which remain unaffected.
